1 · Who you are buying from

Aphelion Prints is a personalised-gift studio operated by Craig Fearn, a UK sole trader (not a limited company, not a marketplace). Email hello@aphelion-prints.com. Business and correspondence address: 124 City Road, London, EC1V 2NX. The business is run from Cornwall, UK, and the address above receives all post and legal notices. Registered with the Information Commissioner's Office.

2 · What you are buying

Made-to-order art prints and gifts, produced by our print partner (Gelato) and shipped to you. They are either catalogue prints of our own artworks, chosen from our standard range, or personalised items made to your specification, such as a star map for a date and place you choose or artwork made from a photograph you upload, which you preview before printing. A personalised item is unique to you and cannot be resold.

3 · Your order and when the contract is made

Placing an order at checkout is an offer to buy. The contract forms when we confirm your order has entered production, not when payment is taken. We may decline an order if a product is unavailable, a personalisation detail is unreadable, or an uploaded image fails a content check; if we decline you receive a full refund. You confirm your personalisation details are correct: we cannot reprint free of charge where you supplied incorrect details.

4 · Prices, VAT and payment

Prices are in GBP and are the full amount you pay; Aphelion Prints is not VAT-registered, so no VAT is added at checkout. Delivery is included where stated. Payment is processed securely by Stripe; we do not see or store your card details.

5 · Your photo / content and what you promise us

When you upload a photograph or supply personalisation details you confirm and warrant that: you took the photograph yourself or own it / hold all rights and permissions to have it reproduced and printed; it does not infringe the copyright, trade-mark, privacy or other rights of any third party; you have the consent of any identifiable person shown; and the content is lawful and not obscene.

6 · Indemnity

You agree to indemnify and hold Aphelion Prints harmless against any claims, losses, damages, costs or expenses (including reasonable legal fees) arising from any image or content you supply, including any claim that it infringes a third party's rights or breaches the promises in clause 5.

7 · Content we can refuse, and takedown requests

We may, at our discretion and without liability, refuse, cancel or refund any order, and remove or delete any uploaded image, where we reasonably believe it breaches these terms or any third party's rights, or following a valid complaint or takedown request. If you believe an image has been used in breach of your rights, contact hello@aphelion-prints.com and we will act promptly to remove it.

8 · AI artwork

Where artwork is generated from your photo it is an artistic interpretation; it is not an exact likeness and we do not guarantee any particular feature, detail or colour is reproduced. You see and choose the preview before anything is printed. On-screen colours may vary slightly from the finished print. Nothing in this clause reduces your statutory right to goods of satisfactory quality and as described (clause 10).

9 · Your data

We use the photograph and details you provide to create your requested preview and fulfil an order you place. The legal basis for that work is taking steps you request before purchase and performing our contract with you. Required accounting records are kept to meet legal obligations; limited order evidence may also be kept where necessary to establish or defend claims. Your image is shared with our print partner (Gelato) solely to produce your order. See our privacy notice for information about how long we retain your photographs, artwork and order records. Deletion of an artwork file does not limit your statutory rights if a print is faulty or not as described. We do not perform facial recognition on your photo and do not use it to train AI models.

10 · Cancellation, returns and your statutory rights

Under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day right to cancel does NOT apply to goods made to your specification or clearly personalised. A star map or Moon print for the place and date you choose, and a print made from your photograph or your wording, are such goods, and we do not accept change-of-mind returns on one once production has started, because we cannot resell it. A catalogue print (one of our own artworks from our standard range, with nothing added by you) is not personalised, so you can change your mind. You can cancel at any time from placing your order until 14 days after the day you receive it, without giving a reason. To cancel, email hello@aphelion-prints.com with your order reference, or send us any other clear statement. Then send the item back within 14 days of telling us; you pay the cost of returning it, and we will tell you where to send it. We refund the price you paid, including standard delivery (but not the extra charge for Priority delivery if you chose it), within 14 days of receiving the item back or of receiving proof that you posted it, whichever is sooner, to your original payment method. If you cancel before the item is sent, we refund in full within 14 days of you telling us. We may reduce a refund if the item has been handled more than was needed to check it, for example if it has been framed, hung or damaged. Your statutory rights under the Consumer Rights Act 2015 are unaffected. If a physical print is faulty, not as described or not fit for its intended purpose, you generally have 30 days from delivery to reject it and request a full refund. Rights to repair or replacement, and to a price reduction or refund where the law provides, can continue after that period. We will provide the remedy you are entitled to at no cost to you. Please contact hello@aphelion-prints.com promptly with your order number and a photo of the issue if possible. Reporting an issue after 30 days, or being unable to supply a photo, does not by itself remove your statutory rights.

Digital downloads are digital content, not goods, and the 14-day right to cancel one runs from the day you buy it. We email the file as soon as your payment clears, and only if, before paying, you tick the box in your basket asking us to do so and confirming that you understand you then lose your right to cancel the download (regulation 37 of the Consumer Contracts Regulations 2013). We confirm your consent in your order confirmation email. Checkout does not go ahead for a download without that consent. If a file is faulty or not as described, your rights under the Consumer Rights Act 2015 are unaffected.

Please check your personalisation and preview carefully before you pay. Correctly reproducing a spelling or detail you supplied is not, by itself, a production fault. This does not limit your statutory rights where the print otherwise fails to meet the contract. See delivery & returns.

11 · Risk and title

Risk passes to you on delivery. Title passes once we have received cleared payment in full.

12 · Our liability

Our liability for any one order is limited to the amount you paid for that order. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law, and nothing in these terms affects your rights under the Consumer Rights Act 2015.

13 · Events beyond our control

We are not liable for delays or failures caused by events beyond our reasonable control (carrier disruption, supplier outages, severe weather, IT failures). Where such an event affects your order we will tell you and offer to wait or refund in full.

14 · Governing law

Governed by the law of England and Wales; disputes subject to the exclusive jurisdiction of its courts. A consumer resident elsewhere in the UK keeps the benefit of any mandatory consumer protections of the law where they live.
